This Privacy Policy explains how PerseusTech LLC, doing business as OrbisIQ (“OrbisIQ,” “we,” “us,” or “our”), collects, uses, discloses, and protects personal information when you access or use OrbisIQ, including our websites, applications, artificial intelligence tools and models, search features, content-generation tools, projects, file and data tools, subscriptions, and related products and services (collectively, the “Services”).

This Privacy Policy also explains the choices and rights that may be available to you regarding your personal information.

By using the Services, you acknowledge the practices described in this Privacy Policy.

1. Information We Collect

We collect information in several ways: directly from you, automatically when you use the Services, from service providers, and from third-party services that you choose to connect or interact with.

A. Account and Profile Information

When you create or use an OrbisIQ account, we may collect information such as:

  • your name or username;
  • email address;
  • account identifiers;
  • profile information;
  • preferences and personalization settings;
  • custom instructions you provide to OrbisIQ;
  • subscription status and plan information;
  • usage balances, purchased usage tokens or credits, and related account entitlements; and
  • account creation, login, and account activity information.

OrbisIQ may use passwordless authentication or third-party authentication services. Depending on the sign-in method you select, authentication providers may also process information in accordance with their own privacy policies.

B. Inputs, Outputs, and User Content

When you interact with the Services, we process the information you submit to OrbisIQ (“Inputs”) and the information generated in response (“Outputs”).

Inputs may include:

  • questions, prompts, and search queries;
  • conversation content;
  • custom instructions;
  • text, documents, spreadsheets, images, audio, video, code, and other files you upload;
  • information contained within Projects;
  • instructions submitted to research, coding, image, file, data, voice, or other tools; and
  • information you choose to provide through other OrbisIQ features.

If you use voice functionality, we may process your audio and a transcription of that audio in order to provide the requested feature.

Inputs may contain personal or sensitive information about you or other people. You are responsible for ensuring that you have the right to provide information that you submit to the Services.

Please avoid providing highly sensitive information that is not necessary for your use of the Services, such as passwords, authentication credentials, full payment-card numbers, Social Security numbers, or similar confidential identifiers.

C. AI Model and Request Information

Because OrbisIQ provides access to multiple artificial intelligence models and providers, we may process technical information associated with each AI request, including:

  • the model requested;
  • the model or version actually used;
  • AI provider or infrastructure provider;
  • input and output usage;
  • request size or token usage;
  • response time and latency;
  • request status;
  • errors and error categories;
  • retry information;
  • fallback or alternative provider routing; and
  • related technical and diagnostic information.

We use this information to provide the Services, administer usage limits, calculate costs, improve reliability, detect errors, prevent abuse, and understand Service performance.

D. Payment and Subscription Information

If you purchase a subscription, trial, additional usage, or another paid feature, we collect information related to your transaction, which may include:

  • name;
  • email address;
  • billing address;
  • subscription or product purchased;
  • transaction amount;
  • payment status;
  • transaction identifiers;
  • refunds, disputes, and chargebacks; and
  • related billing history.

Payments may be facilitated through payment orchestration providers and payment processors such as Primer, Stripe, PayPal, Apple Pay, or other payment providers made available through the Services.

Payment-card information is generally transmitted directly to the applicable payment provider. OrbisIQ does not need to store your complete payment-card number in order to provide the Services.

Payment providers process payment information subject to their own terms and privacy policies.

E. Communications, Support, and Feedback

If you contact us, use customer support, report an issue, provide feedback, complete a survey, or otherwise communicate with OrbisIQ, we may collect:

  • your contact information;
  • the content of your communication;
  • screenshots or files you provide;
  • feedback regarding an AI response;
  • issue and diagnostic information; and
  • related correspondence.

If you provide feedback about a particular AI response, we may process the associated Input and Output as necessary to investigate the feedback and improve the Services.

F. Technical and Usage Information

When you access or use the Services, we may automatically receive information such as:

  • IP address;
  • browser type;
  • device type;
  • operating system;
  • approximate location derived from your IP address;
  • language and time-zone settings;
  • referring and exit pages;
  • pages or features used;
  • dates and times of access;
  • clicks and interactions;
  • session information;
  • crash reports;
  • diagnostic information;
  • cookies and similar identifiers; and
  • information about how you interact with the Services.

G. Guest Usage

Certain OrbisIQ features may be available without creating an account.

When you use the Services as a guest, we may use cookies, local storage, IP information, device information, or similar signals to:

  • provide guest functionality;
  • maintain session continuity;
  • enforce guest usage limits;
  • prevent users from improperly circumventing usage limits; and
  • detect fraud, automated activity, or abuse.

H. Cookies and Similar Technologies

We and our service providers may use cookies, local storage, pixels, software development kits, and similar technologies to operate and secure the Services, remember preferences, understand usage, measure performance, and improve the user experience.

Some cookies are necessary for the Services to function. Other cookies or similar technologies may be used for analytics, attribution, or marketing where permitted by law.

Where required, we will provide appropriate choices or consent controls regarding non-essential cookies.

2. How We Use Information

We may use personal information to:

  • provide, operate, maintain, and improve the Services;
  • process your Inputs and generate Outputs;
  • route requests to the AI model or provider you select or that OrbisIQ selects to fulfill your request;
  • provide web search, Deep Research, image generation, coding, file analysis, data analysis, voice, Projects, personalization, and other features;
  • create and administer your account;
  • remember your settings and preferences;
  • manage subscriptions, trials, usage balances, and transactions;
  • process payments, refunds, disputes, and chargebacks;
  • provide customer service and technical support;
  • communicate with you regarding your account or the Services;
  • send marketing communications where permitted by law;
  • measure and analyze Service usage and performance;
  • improve user interfaces, routing, reliability, features, and functionality;
  • test, troubleshoot, debug, and repair the Services;
  • detect, investigate, and prevent fraud, security incidents, abuse, or violations of our Terms;
  • protect OrbisIQ, our users, and third parties;
  • comply with legal, regulatory, tax, accounting, and reporting obligations;
  • establish, exercise, or defend legal claims; and
  • carry out other purposes disclosed to you or performed with your consent.

We may also create and use aggregated or de-identified information that does not reasonably identify you for analytics, research, product improvement, capacity planning, and other lawful business purposes.

3. How OrbisIQ Uses Third-Party AI Models

OrbisIQ is a multi-model artificial intelligence platform. The Services may allow you to interact with models developed or operated by different third-party AI companies.

To generate a response, OrbisIQ may transmit information necessary to fulfill your request to an AI model provider, model-routing provider, or related infrastructure provider.

Depending on the feature and request, this information may include:

  • your current Input;
  • relevant portions of your conversation;
  • applicable custom instructions or preferences;
  • files or content you have asked the model to analyze;
  • tool instructions; and
  • technical information required to process the request.

The AI model available through OrbisIQ may change over time, and a model may sometimes be served through different infrastructure providers for reasons including availability, reliability, performance, geographic coverage, or cost.

Where supported, we use provider settings and contractual or technical controls designed to limit the use of Inputs and Outputs for third-party model training.

However, AI providers and infrastructure providers have different data-retention and processing practices. Unless a feature is expressly identified as providing a specific retention standard, such as zero data retention, you should not assume that every third-party provider follows the same retention period.

OrbisIQ may change or add AI models and providers without requiring an amendment to this Privacy Policy.

4. AI Training and Improvement of OrbisIQ

OrbisIQ provides access to third-party foundation models and does not currently operate its own general-purpose foundation model trained from your private conversations.

Unless we specifically tell you otherwise, OrbisIQ does not use the content of your private prompts, conversations, or uploaded files to train a proprietary OrbisIQ foundation model.

We may use:

  • aggregated or de-identified usage information;
  • technical performance information;
  • model-selection information;
  • latency, errors, and reliability information;
  • general feature usage; and
  • feedback that you intentionally provide

to evaluate, develop, improve, secure, and operate OrbisIQ.

Information submitted to third-party AI models must still be processed by those providers to generate the requested Output and is subject to the provider-processing practices described above.

5. How We Disclose Information

We may disclose personal information to the following categories of recipients.

AI Model, Routing, and Infrastructure Providers

We may provide information necessary to process your request to AI model providers, model-routing providers, search providers, image or media providers, and related infrastructure providers.

Hosting, Database, and Storage Providers

We use third-party infrastructure providers to host applications, databases, files, and other components of the Services.

Payment Providers

We disclose information necessary to process subscriptions and transactions to payment orchestration providers, payment processors, card networks, digital wallets, banks, and fraud-prevention providers.

Analytics, Communications, and Support Providers

We may use third parties to provide analytics, email delivery, customer support, error monitoring, security, fraud prevention, and other operational services.

Professional Advisers

We may disclose information to lawyers, accountants, auditors, insurers, consultants, and other professional advisers where reasonably necessary.

Legal and Safety Disclosures

We may disclose information if we reasonably believe disclosure is necessary to:

  • comply with applicable law, regulation, subpoena, court order, or legal process;
  • respond to lawful requests from government or law-enforcement authorities;
  • detect, investigate, or prevent fraud, abuse, security incidents, or illegal activity;
  • enforce our agreements and policies;
  • protect the rights, property, or safety of OrbisIQ, our users, or others; or
  • establish, exercise, or defend legal claims.

Corporate Transactions

If OrbisIQ or its business is involved in a merger, financing, acquisition, reorganization, bankruptcy, sale of assets, or similar corporate transaction, personal information may be disclosed or transferred as part of that transaction.

At Your Direction

We may disclose information when you instruct us to do so, including when you use a feature that interacts with or transmits information to a third-party service.

6. Advertising and Sale of Personal Information

OrbisIQ does not sell your personal information for money.

We do not provide your private prompts, queries, conversation content, or uploaded files to advertisers so that advertisers can use that content to target advertisements to you.

We may use advertising, attribution, or measurement technologies to understand whether our advertising campaigns result in visits, registrations, or purchases. These technologies may process website-level information such as device identifiers, IP address, referral information, page activity, or conversion events.

If our use of such technologies constitutes “sale,” “sharing,” or “targeted advertising” under applicable privacy law, we will provide the opt-out rights required by that law.

7. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services and accomplish the purposes described in this Privacy Policy.

The appropriate retention period depends on factors including:

  • the type of information;
  • why we collected it;
  • how long your account remains active;
  • whether the information is contained in a Project or saved conversation;
  • security and fraud-prevention requirements;
  • contractual requirements;
  • legal, tax, accounting, and regulatory obligations; and
  • the need to resolve disputes or enforce agreements.

Conversation history and content saved to your account may generally remain available until you delete that content or your account, subject to technical, security, legal, and backup requirements.

Files retained as part of a Project or other persistent feature may remain stored until you delete the applicable file, Project, or account.

When information is deleted from active systems, residual copies may remain temporarily in secure backups, logs, fraud-prevention records, or systems used to comply with legal obligations.

Third-party AI providers and other service providers may have their own retention periods as described in Section 3.

8. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, and disclosure.

These safeguards may include access controls, authentication controls, encryption, monitoring, logging, security testing, and other technical measures appropriate to the nature of the information being processed.

No internet transmission, software platform, or electronic storage system can be guaranteed to be completely secure. Accordingly, we cannot guarantee the absolute security of information.

9. International Data Transfers

OrbisIQ and the companies that support the Services may process information in the United States and other countries.

As a result, your personal information may be transferred to and processed in a country whose privacy laws differ from those where you live.

Where required by applicable law, we use appropriate safeguards for international transfers of personal information, which may include contractual protections or other legally recognized transfer mechanisms.

10. Legal Bases for Processing

If you are located in the European Economic Area, United Kingdom, Switzerland, or another jurisdiction that requires a legal basis for processing personal information, our legal bases may include:

  • Performance of a contract. We process information when necessary to provide the Services you request, operate your account, generate AI responses, and administer subscriptions or purchases.
  • Legitimate interests. We may process information when necessary for legitimate business interests such as securing and improving the Services, preventing fraud, understanding product performance, providing customer support, and enforcing our agreements, provided those interests are not overridden by your rights.
  • Consent. We rely on consent where required, including for certain cookies, marketing communications, device permissions, or features that require access to particular categories of information.
  • Legal obligations. We may process information where necessary to comply with applicable law or legal process.

11. Your Privacy Rights and Choices

Depending on where you live, you may have rights regarding your personal information.

These may include the right to:

  • request confirmation that we process personal information about you;
  • access personal information we maintain about you;
  • request correction of inaccurate personal information;

  • object to or restrict certain processing;
  • withdraw consent where processing is based on consent;
  • opt out of certain targeted advertising, sale, or sharing of personal information where applicable;
  • appeal a decision we make regarding a privacy request where applicable; and
  • lodge a complaint with an applicable data-protection authority.

These rights are not absolute. Applicable law may permit or require us to retain certain information or decline a request in particular circumstances.

We may need to verify your identity before fulfilling a privacy request. Authorized agents may submit requests where permitted by applicable law, subject to appropriate verification.

You will not be discriminated against for exercising privacy rights provided by applicable law.

12. Account and Data Choices

Depending on the features available within your account, you may be able to:

  • delete individual conversations;
  • delete uploaded files;
  • delete Projects;
  • modify personalization or custom instructions;
  • manage communication preferences;
  • manage cookie preferences;
  • cancel a subscription; or
  • request deletion of your account.

Unsubscribing from promotional messages does not prevent us from sending non-promotional communications regarding your account, transactions, security, or the Services.

13. U.S. State Privacy Disclosures

Residents of certain U.S. states may have additional privacy rights under state consumer privacy laws.

Depending on the law that applies to you, these rights may include access, correction, deletion, portability, obtaining information about disclosures, opting out of targeted advertising or certain data transfers, and appealing a denied privacy request.

During the preceding twelve months, the categories of personal information we may have collected are described in Section 1 of this Privacy Policy. The purposes for which we collect and use that information are described in Section 2, and the categories of recipients to whom information may be disclosed are described in Section 5.

We do not sell personal information for money.

We do not disclose the content of your private prompts, queries, conversations, or uploaded files to advertisers for cross-context behavioral advertising.

If our advertising or measurement practices constitute a “sale,” “sharing,” or use for “targeted advertising” under applicable law, you may exercise the corresponding opt-out right.

14. Third-Party Services and Links

The Services may allow you to access, connect to, or interact with websites, AI providers, applications, search providers, payment services, or other third-party services.

When you choose to interact with a third-party service, that third party may receive information directly from you or from OrbisIQ as necessary to complete the interaction.

We do not control the privacy practices of third parties. Their collection and use of information are governed by their own privacy notices and terms.

You should review the privacy practices of third-party services before providing them with personal information.

15. Children

The Services are intended for individuals who are 18 years of age or older.

We do not knowingly collect personal information from anyone under 18 through an account that is not permitted under our Terms of Service.

If you believe that a person under 18 has provided personal information to OrbisIQ in violation of our Terms, please contact us so that we can investigate and, where appropriate, remove the information.

16. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to the Services, our practices, technology, legal requirements, or other factors.

When we make changes, we will update the “Last Updated” date at the top of this Privacy Policy.

If we make material changes, we may provide additional notice through the Services, by email, or by another appropriate method as required by law.

Your continued use of the Services after an updated Privacy Policy becomes effective is subject to the updated Privacy Policy, except where applicable law requires additional notice or consent.
